Terms of Service – The Path of Today

By installing or using “The Path of Today” (the “Service”) provided by upship kim (the “Company”), you agree to these Terms of Service.
1. About the Service
The Path of Today is an app that offers GPS-based walk and hiking route tracking, mood/emotion journaling, photo attachments, step counting, activity statistics, and reminder notifications.
2. Changes to These Terms
The Company may update these Terms from time to time. When changes are made, we will notify you at least 7 days before the effective date via in-app notice or update release notes. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you may stop using the Service by deleting the app.
3. User Obligations
You agree not to:
- Use the Service for any unlawful purpose
- Interfere with or disrupt the normal operation of the Service
- Reverse engineer, decompile, or disassemble the app
- Use the Service to infringe upon the rights of others
- Violate any applicable laws or regulations
4. Content Ownership
All content you create through the Service (routes, moods, photos, notes, etc.) belongs to you.
- The Company does not access or store your content on any server.
- All content is stored solely on your device; backup and management are your responsibility.
- Deleting the app permanently removes all content stored on your device.
5. Privacy
The Company operates on a Local-First principle — your personal information is not collected or stored on our servers. Third-party tools used for service stability and error analysis may process limited technical information. See our Privacy Policy for details.
6. Disclaimers
- Accuracy: GPS routes, step counts, and distances are for reference only and must not be used for medical, safety, or legal purposes.
- Data Loss: The Company is not liable for data loss caused by device failure, loss, theft, OS updates, or app deletion. All data is stored locally and backup is your responsibility.
- Service Interruption: The Company is not liable for service limitations caused by force majeure, OS policy changes, or third-party service outages.
- Health & Safety: The Service is not a medical device, and activity records are not a substitute for professional health advice. You are responsible for your safety during walks; however, this does not apply to damages caused by the Company’s willful misconduct or gross negligence.
7. Intellectual Property
All intellectual property rights in the Service — including design, source code, logos, icons, and UI — belong to the Company. The Service may only be used for personal, non-commercial purposes.
8. Limitation of Liability
For the free Service, the Company shall not be liable for damages to users unless otherwise required by applicable law. If paid features are introduced, separate terms will apply.
9. Termination
You may terminate use of the Service at any time by deleting the app. No separate withdrawal process is required as there is no account system. All locally stored data will be permanently deleted upon app deletion.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of Korea. Any disputes shall be subject to the exclusive jurisdiction of the Seoul Central District Court, except where mandatory local laws of your country of residence apply.
